01. About Tordoa

Tordoa is a technology platform and online marketplace.

Tordoa is not a real estate broker, real estate agent, property manager, landlord, tenant, or party to any lease or rental agreement between users.

Tordoa does not:

• Negotiate leases on behalf of users
• Represent renters or landlords
• Guarantee the accuracy, availability, quality, safety, legality, or suitability of listings or renter profiles
• Guarantee that a renter will find a property or that a landlord will find a renter
• Conduct credit checks, background checks, identity verification, or income verification
• Guarantee that information provided by users is accurate or complete

Any rental transaction, lease, payment, showing, agreement, or other interaction between users is between those users.

02. Eligibility

You must be at least 18 years old to use Tordoa.

By using Tordoa, you represent that you meet this age requirement and have the legal capacity to agree to these Terms.

03. Accounts

Certain Tordoa features require an account.

You agree to:

• Provide accurate information
• Keep your account information reasonably current
• Maintain the security of your account
• Not impersonate another person
• Not create accounts for fraudulent or abusive purposes
• Not knowingly maintain multiple accounts for purposes that violate these Terms

You are responsible for activity occurring through your account.

04. Renter Profiles

Renters may create profiles describing the type of housing they are seeking.

Renter profiles may include:

• Desired location
• Property type
• Bedrooms and bathrooms
• Budget
• Desired move-in date
• Lease preferences
• Amenities and housing preferences
• Pet information
• Self-reported income range
• Optional biography or profile information
• Profile personalization information
• Optional profile photo

Profile photos are stored privately and are never displayed to other users. Other users see coloured initials.

Income information is self-reported and is not independently verified by Tordoa.

You are responsible for ensuring that information you provide is accurate and not misleading.

Tordoa may allow landlords to discover renter profiles based on information provided by renters.

Users may be able to hide, deactivate, or delete profiles through available account functionality.

05. Property Listings

Users who create or manage property listings represent that:

• They own the property or are authorized to advertise it
• The listing information is accurate to the best of their knowledge
• They have the right to use the photos and other materials they submit
• The property is or is expected to be available as represented
• Their listing complies with applicable laws and regulations

Users are responsible for updating or deactivating listings when information becomes inaccurate or a property is no longer available.

06. Tordoa-Prepared Draft Listings

Tordoa may, as part of its marketplace development or outreach efforts, prepare a private draft listing using publicly available property information and materials.

A Tordoa-prepared draft listing is not automatically a public representation by the property owner.

The property owner or authorized representative may review the draft, request changes, and decide whether to publish it.

If a user publishes or claims a listing, that user is responsible for the accuracy of the final listing and for having the necessary rights to use its information and photographs.

Tordoa may remove or modify a draft or listing upon request or when necessary to comply with these Terms or applicable law.

07. Fair Housing And Anti-Discrimination

Users must comply with all applicable federal, state, and local fair housing and anti-discrimination laws.

Federal law prohibits discrimination in housing on the basis of race, colour, national origin, religion, sex (including sexual orientation and gender identity), familial status, and disability.

The City of Austin prohibits discrimination on those bases and additionally on the basis of age, marital status, student status, sexual orientation, gender identity, and source of income for veterans.

Landlords must also provide reasonable accommodations and modifications for disability where the law requires, including for assistance animals, regardless of any pet policy stated in a listing.

You may not use Tordoa to:

• Discriminate against another person in housing
• Express unlawful discriminatory preferences
• Facilitate unlawful housing discrimination
• Engage in unlawful steering
• Use protected characteristics to unlawfully determine housing availability or eligibility
• Create or use discriminatory filters, preferences, or search criteria where prohibited by law

Tordoa may remove content, restrict features, suspend accounts, or terminate accounts when we believe activity violates applicable law or these Terms.

08. Prohibited Conduct

You may not use Tordoa to:

• Create fraudulent or misleading listings or renter profiles
• Impersonate another person or entity
• Harass, threaten, stalk, or abuse another user
• Send spam or unrelated solicitation
• Use Tordoa primarily for advertising, recruiting, or commercial solicitation unrelated to its intended rental marketplace purpose
• Scrape, collect, or systematically extract information from Tordoa without authorization
• Attempt to bypass security, authentication, access controls, or usage restrictions
• Reverse engineer or interfere with the platform except where permitted by applicable law
• Upload malware, malicious code, or harmful content
• Infringe another person's intellectual property, privacy, or other rights
• Use Tordoa for unlawful purposes
• Interfere with the operation or security of Tordoa

09. Messages And Communications

Tordoa may provide messaging functionality that allows users to communicate directly.

Messages may be stored as part of operating the service.

We do not routinely review all user communications. However, we may access, review, preserve, or disclose information when reasonably necessary to:

• Investigate abuse, fraud, or security issues
• Enforce these Terms
• Protect users or Tordoa
• Comply with legal obligations
• Respond to lawful requests

Do not send passwords, financial account credentials, government identification numbers, Social Security numbers, or other highly sensitive information through Tordoa messaging.

10. User Content

You retain ownership of content you submit to Tordoa, subject to the rights necessary for Tordoa to operate the platform.

By submitting listings, renter profiles, photos, descriptions, messages, or other content, you grant Tordoa a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, transmit, and otherwise use that content as reasonably necessary to operate, maintain, promote, and improve Tordoa.

You represent that you have the rights necessary to submit the content and grant this license.

11. Fees And Paid Services

Tordoa may offer certain features or services for free and may introduce paid services.

If Tordoa charges fees for a service, the applicable price and material terms will be presented before you are charged.

Unless otherwise stated, fees are non-refundable to the extent permitted by applicable law.

Tordoa may change pricing or paid features with appropriate notice.

12. User-To-User Transactions

Tordoa does not participate as a party in transactions between renters and landlords.

Users are responsible for independently evaluating:

• Properties
• Listings
• Renter profiles
• Identity and authority
• Financial information
• Lease terms
• Payments
• Property conditions
• Safety
• Compliance with applicable laws

Tordoa does not guarantee that a user will perform as promised or that a transaction will be completed.

13. Suspension And Termination

We may suspend, restrict, or terminate access to Tordoa if we believe that a user:

• Violates these Terms
• Violates applicable law
• Engages in fraud, abuse, harassment, or security-related misconduct
• Creates risk for Tordoa or other users
• Uses the platform in a manner inconsistent with its intended purpose

Users may stop using Tordoa at any time and may delete their account through available account functionality.

Certain provisions of these Terms may continue to apply after termination, including provisions concerning user content, disclaimers, limitations of liability, indemnification, and disputes.

14. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TORDOA IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

TORDOA DOES NOT GUARANTEE THAT THE PLATFORM WILL ALWAYS BE AVAILABLE, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.

TORDOA DOES NOT GUARANTEE THE ACCURACY, COMPLETENESS, AVAILABILITY, QUALITY, SAFETY, OR LEGALITY OF USER-GENERATED CONTENT, LISTINGS, RENTER PROFILES, OR COMMUNICATIONS.

TORDOA DOES NOT GUARANTEE ANY RENTAL, LEASE, MATCH, INTRODUCTION, PAYMENT, OR OTHER RESULT FROM USE OF THE PLATFORM.

15. Limitation Of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TORDOA AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS ARISING FROM OR RELATED TO YOUR USE OF TORDOA.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TORDOA'S TOTAL LIABILITY ARISING FROM OR RELATED TO YOUR USE OF THE PLATFORM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO TORDOA FOR THE SERVICE GIVING RISE TO THE CLAIM DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow certain limitations of liability, so some portions of this section may not apply to you.

16. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Tordoa and its owners, officers, employees, contractors, and service providers from claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to:

• Your use of Tordoa
• Your violation of these Terms
• Your content
• Your violation of another person's rights
• Your violation of applicable law
• Your interactions or transactions with other users

17. Governing Law And Disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except to the extent that applicable law requires otherwise.

To the extent permitted by applicable law, the parties agree that the courts located in Travis County, Texas will be a permitted venue for disputes arising out of or relating to these Terms or your use of Tordoa. Nothing in this section is intended to waive or restrict any right, remedy, or forum that cannot lawfully be waived or restricted.

Any dispute-resolution process will be subject to applicable law.

18. Changes To These Terms

We may update these Terms from time to time.

When we make changes, we will update the “Last Updated” date at the top of these Terms. Material changes may also be communicated through the platform or other appropriate means.

Your continued use of Tordoa after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.
